Terms of Service
These Terms of Service ("Terms") govern your use of PostBaton, a social media scheduling service provided by NJLIGames LLC ("PostBaton", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use PostBaton.
The service
PostBaton lets you compose a post once and schedule it to publish to the social platforms you connect, with the goal of publishing each post exactly once, on time, and reporting the result back to you.
Your account
You must be at least 18 years old to use PostBaton. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Tell us promptly at info@postbaton.com if you suspect unauthorized use.
Acceptable use
You agree not to use PostBaton to publish unlawful, infringing, deceptive, or harmful content, to send spam, or to violate the terms of any connected social platform. You are responsible for the content you schedule and publish, and for having the rights to use it. We may suspend or remove access for conduct that breaks these Terms or puts the service or other users at risk.
Connected platforms
PostBaton publishes to third-party platforms such as Instagram, Facebook, X, TikTok, YouTube, LinkedIn, and Threads. Those platforms are controlled by their owners, not by us. Their availability, rules, and APIs can change at any time, and you must comply with each platform's own terms. We are not responsible for a platform's decisions, outages, or changes that affect publishing.
Plans, billing, and cancellation
PostBaton offers a free plan and paid plans. Paid plans are billed in advance through our payment processor, Stripe, on a recurring basis until cancelled. Each plan includes a set number of connected accounts at a flat price. You can cancel at any time from your account settings and will keep access through the end of your current billing period. Unless required by law, payments are non-refundable. We will give reasonable notice of any price change.
Your content
You own the content you create and schedule. You grant us the limited license needed to store, process, and transmit that content to the platforms you select, solely to provide the service. You can export or delete your content at any time.
Reliability and availability
We work hard to publish exactly once, on time, and to surface a clear alert when something cannot be delivered. Even so, we do not guarantee uninterrupted or error-free service, because publishing depends on third-party platforms and networks outside our control.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, NJLIGames LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim.
Indemnification
You agree to indemnify and hold NJLIGames LLC harmless from claims arising out of the content you publish through PostBaton or your breach of these Terms.
Termination
You may stop using PostBaton and close your account at any time. We may suspend or terminate access if you breach these Terms or if we must do so to protect the service or comply with the law. Sections that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York will have jurisdiction over any dispute that is not resolved informally.
Changes to these Terms
We may update these Terms as the product evolves. When we make a material change, we will update the date above and, where appropriate, notify you in the app or by email. Continued use after a change means you accept the updated Terms.
